Punjab National Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.23,00,034/- with interest against Smt. Gurmeet Kaur and others (defendants).

Bank’s case is that on 26.04.2016, it had granted a loan of Rs.15.00 Lacs to defendant i.e. Smt. Gurmeet Kaur (since deceased now represented through her legal heirs) in the form of K.C.C Limit for agricultural purpose. To secure the loan, Defendant i.e. Sh. Gurmit Kaur (now deceased) had mortgaged her land (fully detailed in para No.3A of the application). The loan was chargeable to interest @11.50% per annum with yearly rests. Defendants had duly acknowledged their liability towards the debt on 12.04.2019, 24.09.2022. On 31.08.2022, a

sum of Rs.23,00,034/- was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 12.01.2023, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance.

During the course of proceedings, IA No.664 of 2024, filed by the applicant bank for impleading the legal heirs of the deceased defendant, along with amended memo of parties was allowed vide order dated 13.05.2024. The legal heirs of the deceased defendant appear before this Tribunal despite serving the summons. Vide order dated 01.08.2025, all the defendants were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Gurpreet Singh, Authorized Officer along with the loan and security documents and marked them as Exhibit A-1 to A-10. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of Rs.15.00 Lacs and on 31.08.2022, a sum of Rs.23,00,034/- was due. 6. Accordingly, the application of the bank for the recovery of Rs.23,00,034/- (Rupees Twenty Three Lacs Thirty Four Only) with interest @11.50% per annum with yearly rests from 29.11.2022, till the date of payment is hereby allowed with costs. The liability of the legal heirs of the deceased defendant i.e. Smt. Gurmeet Kaur would be limited upto the extent of the property inherited by them from Smt. Gurmeet Kaur (now deceased). Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the

movable and immovable property(ies) inherited by legal heirs from Smt. Gurmeet Kaur (now deceased).

Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly. 9. Parties are directed to appear before Recovery Officer on 04.03.2026, who is directed to distribute the sale proceeds of the mortgaged land and standing crops as per the provisions of Section 19(20-AB) of the Act . 10.
