The Applicant Bank filed the^{present OA against Defendantfor} recovery of a total sum of Rs.^{23,41,424.00 Ps. ( Rupees} Twenty Three Lakhs Fofi One Thousand Four^Hundred and Twenty Four Only) i.e s sum of -

(i) Rs.20,89,181.00 Ps. with future rate of^interest @10.80%^{p.a with monthly restsfrom 26.022026 till the} date of realization.

(ii) Rs.2,52,243.00 Ps. with future rate of interest @11.65Yo p.a with monthly rests from 26.02.2026 till the date of realization.

@10.80%^{p.a with monthly} rests and executed^personal Loan Agreement dated 12.09.2022 in favorof the Applicant Bank. The Defendant availed Top up loan under Xpress Credit Top Up Loan of Rs.3,00,0001 repayable in 36 equated monthly installments of Rs.9,915/- p.m with interest @11.65oh p.a with monthly rests 0n 05.12.2023 from the Applicant Bank. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NPA on 12.03.2025 and 14.03.2025 and issued Legal Notice dated 27.03.2025 to the defendant. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Sri. Pavan Kumar Kavati, Assistant Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.9.

Defendant remained exparte. To substantiate the case of^the Applicant Bank, AW.1 , official of the Applicant Bank^was examined and he exhibited relevant documents as Ex.A.'l^to A.9. ln view of the above, I hold that the Applicant Bank^has established their claim made in the OA against the Defendant^and hence the Applicant Bank is entitled to recover the claim^madein the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under^:

The Defendant is liable to^pay to the Applicant Bank a total^sum of Rs. 23,41,424.00 Ps. ( Rupees Twenty Three Lakhs Forty One Thousand Four Hundred and Twenty Four Only) i.e^s sum of -

Rs.20,89,181.00 Ps. with future. rate of interest @1O.80%^{p.a from 26.O2.2026 till the date of realization.}

The Applicant Bank is entitled to^proceed against the^person of Defendant towards realization of the debt
