Punjab Gramin Bank (Bank) has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹26,33,863.11p with interest against Sh. Naranjan Singh (since deceased now survived by his legal heirs) (defendants).

Bank’s case is that on 19.05.2016, it had granted a loan of ₹18.00Lacs in the form of K.C.C Limit for agricultural purpose to deceased defendant. To secure the loan, Deceased Defendant had mortgaged his land (fully detailed in para No.3A of the application). The

loan was chargeable to interest @12.35% per annum with half-yearly rests. The defendant had acknowledged the liability towards the debt on 12.03.2019 and 06.10.2021. On 30.09.2024, a sum of ₹26,33,863.11p was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 09.12.2024, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 16.05.2025, he proceeded was ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Ms. Manny, Authorised Officer along with the loan and security documents and marked them as Exhibit A-1 to A-10. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of ₹18.00Lacs and on 30.09.2024, a sum of ₹26,33,863.11p was due. 6. Accordingly, the application of the bank for the recovery of ₹26,33,863.11p (Rupees Twenty Six Lacs Thirty Three Thousand Eight Hundred Sixty Three and Eleven Paise Only) with interest @12.35% per annum with half-yearly rests from 04.10.2024, till the date of payment is hereby allowed with costs. The liability of the legal heirs of Defendant would be limited to the extent of property inherited by them from Naranjan Singh. Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendant.
