The Applicant Bank filed the present OA against Defendant for recoveryof atotal sumof Rs.41,42,543.00ps. (Rupees Fofi One Lakhs Forty Two Thousand Five Hundred and Forty Three Only) with contractual rate of interest @1O.SOyo p.a with monthly rests from 06.02.2026 till the date of realization and in default for sale of Mortgaged properties as mentioned in the Schedule of Properties I and ll to OA.
As per the averments in the application, the Applicant Bank states that Defendant availed loan under Fund Based Working Cpital (FBWC/ Cash Credit toan of Rs.1,00,00,000/- with interest and executed Letter of Arrangement dated 04.01.2019 in favor of the Applicant Bank. The Defendant created Equitale Mortgage morefully mentioned in Schedule of properties I and ll to OA and executed Mortgage Deed dated 05.01.2019 in favor of the Applicant Bank and deposited original Sale Deed in favor of the Applicant Bank. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank classified the account as NpA on 31.03.2024 and issued Legal Notice dated 19.11.2025 to the defendant. lnspite of several requests and demands, the defendant did not clear the ence this OA.
