Bank of India (Bank) has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.35,87,519.02p with interest against M/s Navtej Singh and another (defendants).

Bank’s case is that on 24.07.2012, it had granted a loan of Rs.25.00Lacs to defendant no.1 through its proprietor Defendant no.2 in the form of C.C Limit under C.G.T.S.M.E. Scheme for business purpose. To secure the loan, Defendant no.1 had hypothecated assets (fully detailed in para No.3A of the application). On 20.07.2020, bank granted

a loan of Rs.5.00Lacs in the form of G.E.C.L. Loan to defendant no.1 through its proprietor. The loans were chargeable to different rates of interest. The defendants had acknowledged the liability towards the debt on 19.01.2014, 02.02.2016, 13.6.2017 and 10.06.2020. On 03.06.2023, a sum of Rs.35,87,519.02p was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application.

On 05.07.2023, summonses were sent to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 23.03.2026, they were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Mr. Prabhat Kuamr Sunam, Authorised Officer along with the loan and security documents and marked them as Exhibit A-1 to A- .21 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced loans under different schemes and on 03.06.2023, a sum of Rs.35,87,519.02p was due.

Accordingly, the application of the bank for the recovery of Rs.35,87,519.02p (Rupees Thirty Five Lacs Eighty Seven Thousand Five Hundred Nineteen and Two Paise Only) – Rs.30,10,205.81p with interest @12.85% per annum with monthly rests in the C.C. Limit and Rs.5,77,313.21p in the G.E.C.L. Limit with interest @9.25% per annum with monthly rests from 08.06.2023, till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover its dues by the sale of hypothecated assets
