This Original Application is filed on 30.05.2022 by the Applicant Bank under Section 19 of Recovery of Debts and Bankruptcy Act, 1993 (formerly Recovery of Debts Due to Banks and Financial Institutions Act, 1993) against the defendants 1 to 4, jointly and severally for recovery of a total sum of Rs.72,60,069.44p (Rupees Seventy Two Lakhs Sixty Thousand and Sixty Nine and Forty Four Paise only) due in respect of Cash Credit Hypothecation Facility (Account No.75240500000338 (Old A/c. No. 086313023830) and a sum of Rs.23,65,291.04p due in respect of Term Loan A/c No. 75240600001404 (Old A/c No. 0863540238731) together with further interest @ 11.15% p.a., with monthly rests from the date of Application till the date of realization in full, the liability of defendants is restricted to the extent of estate inherited by them from deceased Guarantor, Late Rahamath Beevi and for costs of this Original Application.

Brief Facts of the case:

The Applicant submits that the application is filed within the period of limitation as prescribed under Section 24 of the Recovery of Debts and Bankruptcy Act, 1993, and the subject recovery claim falls within the jurisdiction of this Tribunal.

It is the case of the Applicant Bank that the applicant previously known as Dena Bank, a body corporate constituted under the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 carrying on business of banking was amalgamated with Bank of Baroda a Scheme of Amalgamation called as Amalgamation of Vijaya Bank and Dena Bank with Bank of Baroda Scheme, 2019 as per Gazette Notification dated 02.01.2019.

It is submitted by the applicant bank that the 1^st defendant herein is a proprietorship concern represented by the 2^nd defendant, its Sole Proprietor doing business of manufacture of coils, roofing materials for roofing purpose. The 1^st Defendant, represented by the 2^nd Defendant, initially applied to the Applicant Bank for a Cash Credit Hypothecation Limits for working capital requirements for Rs. 20,00,000/-.

It is submitted by the applicant bank that after examining their application, the Applicant Bank sanctioned Cash Credit Hypothecation facility for Rs. 20,00,000/- on 12.08.2015 against security of Stock and Book Debts with interest at 2.40% i.e. 12.40% (Floating). thereon at S. No. 37/3, Perumalkoil Street, Singlimedu Road, Dhargas No.26, Vilangadukuppam Village, Madahavaram Taluk, Chennai - 600052. The 1^st Defendant represented by the 2^nd Defendant and Rahamath Beevi(deceased) signified their acceptance by signing the same.

It is further submitted that applicant bank had sanctioned an enhancement by Rs. 20,00,000/- in the Cash Credit Hypothecation Limit to Rs. 40,00,000/- on 02.12.2016 against 25% on stocks and 50% on book-debts with interest at MCLR +2.30% i.e. 11.75% (Floating) and collateral security of extension of equitable mortgage of land and building thereon at S.No. 37/3, Perumalkoil Street, Singlimedu Road, Dhargas No.26, Vilangadukuppam Village, Madahavaram Taluk, Chennai-600052 belonging to 2^nd Defendant. The 1^st Defendant represented by the 2^nd Defendant signified the acceptance of sanction terms and conditions by signing the same.

The 1^st Defendant represented by 2^nd Defendant applied for Fresh Cash Credit Hypothecation Limit of Rs.40,00,000/- and a Term Loan for Rs. 25,00,000/- for purchase of machinery on 02.03.2017 which was sanctioned by the Applicant Bank. The Applicant Bank on 27.07.2017 sanctioned Cash Credit Hypothecation Adhoc limits for Rs.15,00,000/- for purchase orders with total Cash Credit Hypothecation limit of Rs.55,00,000/- (Rs. 40,00,000/- + Rs. 15,00,000/-) against Stock and Book-debts and collateral security of extension of Equitable Mortgage of land and building thereon at S. No. 37/3, Perumalkoil Street, Singlimedu

Road, Dhargas No.26, Vilangadukuppam Village, Madahavaram Taluk, Chennai-600052 belonging to 2^nd Defendant with interest at MCLR 9.1 + 2.3% i.e. 11.40% (Floating) with monthly rests repayable in 12 months subject to annual review for their working capital requirement. The sanction letter ref. no. DB/Alwarp/ADV/2017-18 dated 27.07.17 was accepted by the 1^st Defendant.

The applicant bank submits that Mrs. Rahamath Beevi W/o Shaghul Hameed, the 2^nd Defendant agreed to guarantee the Cash Credit Hypothecation and the Term Loan facility and executed Letter of Guarantee. The said Rahamath Beevi died on 11.03.2022 leaving behind 2^nd Defendant, her husband and the 3^rd and 4^th Defendants, her son and daughter respectively. Rahamath Beevi has declared that the 3^rd and 4^th defendants are her son and daughter in the Agreement of Hypothecation dated 21.06.2017 to secure the goods, book debts and multiple facilities executed by her in respect of credit facility availed by her as Sole Proprietor, SRAA Polymers at Sembudoss Street branch of the Applicant Bank.

The 2^nd Defendant as such is a party to the Original Application being a Borrower and after the demise of Rahamath Beevi he would also stand arrayed as legal heir of the deceased Rahamath Beevi. The 3^rd and 4^th Defendants being the son and daughter of Rahamath Beevi and also her legal heirs stand arrayed as they are liable to extent of estate if any to be inherited from Late Rahamath Beevi. It is submitted by the applicant bank that the Defendants agreed to the terms and conditions of the sanction and signified their acceptance by signing the sanction letter with respect to the aforesaid limits and availed the total Cash Credit Hypothecation Limit of Rs.55,00,000/- (Rs. 40,00,000/- plus Adhoc Limit of 15,00,000/-) vide Account No.(Old A/c No.086313023830) and the Term Loan (Machinery) for Rs. 25,00,000/vide A.c No. (Old A/c No. 086354023873) by executing the following documents:

The 2^nd Defendant who is the Sole Proprietor of 1^st Defendant created mortgage by deposit of title deeds on 13.08.2015 relating to immovable property of Land measuring to an extent of 5 cents (2462 sq.ft) (228.72 sq.mtr) in No.26, Vilangadupakkam village, comprised in Grama Natham Survey No.37/3, Madhavaram Taluk, Thiruvalluvar district morefully described in Schedule -B with an intention to create mortgage of the Schedule B property to secure the due repayment of the Cash Credit Hypothecation Facility for Rs.20,00,000/- extended to the Defendant 1 represented by Defendant 2 together with interest, cost and other charges thereon and executed Memorandum of Deposit of Title Deeds dated 13.08.2015 duly registered as Document No.7763 of 2015 in Sub-Registrar Redhills. On 05.12.2016 the 2^nd Defendant executed Memorandum of Deposit of Title Deeds dated 05.12.2016 duly registered as Document No. 936 of 2016 in Sub-Registrar, Redhills On 28.02.2017 the 2^nd Defendant executed Supplemental Memorandum of deposit of title deeds duly registered as Doc. No.737/2017 in SRO, Redhills.

It is submitted by the applicant bank that subsequent to availing of loan, the Defendants failed to operate the Cash Credit Hypothecation Limit and Term Loan satisfactorily resulting in the Account becoming sticky and non-performing and was classified as NPA on 31.03.2018 in

accordance with RBI guidelines. Inspite of various demands/reminders to regularize the accounts, the Defendants failed to regularize the same.

As there was no positive response to demands of the Applicant, SARFAESI action was initiated and Possession Notice dated 05.07.2018 was issued, which was acknowledged by the Defendants. As there was no positive response, the Applicant proceeded further with sale of the secured asset i.e., the immovable property of Land measuring to an extent of 5 cents (2462 sq.ft) (228.72 sq.mtr) in No.26, Vilangadupakkam village, comprised in Grama Natham Survey No.37/3, Madhavaram Taluk. Thiruvalluvar district. The said secured asset was sold for Rs. 19,80,000/- on 25.02.2021 and after receipt of the entire sale value and after deducting TDS of Rs. 14850/- an amount of Rs. 19,65,150/- was credited to the liability Account on 29.03.2021. The TDS was also refunded and credited to the Liability account on 21.10.2021. The Sale Certificate dated 24.03.2021 was also issued.

The Applicant submits that on account of the default committed by the Defendants in discharging their admitted liability in accordance with the terms accepted by them, the Applicant Bank called upon the Defendants to discharge their liability. The defendants herein failed and neglected to discharge their liability. Hence the present Original Application (OA) has been filed by the applicant bank for recovery of its dues from the defendants.

After the filing of the OA, summons were sent to the Defendants 1 to 4 through Registered Post with Acknowledgment Due, which returned unserved with postal endorsement as ‘door locked’ in respect of all the defendants. Applicant Bank had caused paper publication of the notice and filed proof thereof. When OA was taken up on 26.09.2023 even after giving sufficient time, there was no appearance or representation from the defendants. Hence, Defendants 1 to 4 were placed ex-parte on 26.09.2023.

Heard the submissions of Applicant Bank and perused the records.

To prove the case of the Applicant Bank, Sh. Subodh Kumar, Chief Manager of the Applicant Bank, has filed his Affidavit by way of evidence and same was considered as evidence of AW-1 and list of documents came to be marked as Ex. A-1 to A-48 . As the Defendants remained exparte, the OA claim remains unchallenged. There is no contra evidence available on record to repudiate the claim of the Applicant Bank.

With regard to the amount advanced, the interest applied, the conduct and operations in the account and the default committed, this Tribunal comes to the conclusion that the applicant bank is entitled for a final order on the following terms:

The OA is allowed with costs,

(a) The applicant bank is allowed to recover from the Defendants jointly and severally, i.e., from defendants 1 and 2 jointly and severally and from defendants 3 and 4 to the extent of estate inherited by them from deceased Guarantor, Late Rahamath Beevi, for recovery of a total sum of Rs.72,60,069.44p (Rupees Seventy Two Lakhs Sixty Thousand and Sixty Nine and Forty Four Paise only) as follows:

(i) A sum of Rs.48,94,778.40p due in respect of Cash Credit Hypothecation Facility (Account No.75240500000338 (Old A/c. No. 086313023830)

repayable together with further interest @ 10.65% p.a., with monthly rests from the date of Application till the date of realization in full;

(ii) A sum of Rs.23,65,291.04p due in respect of Term Loan A/c No. 75240600001404 (Old A/c No. 0863540238731) repayable together with further interest @ 11.15% p.a., with monthly rests from the date of Application till the date of realization in full, along with costs of this application.

(b) If the sale proceeds of the immovable property is not sufficient to satisfy the dues as ordered above, the applicant bank

is at liberty to sell the personal assets of the 2^nd Defendant (both movable and immovable) to recover the balance dues as required under law for which the 2^nd Defendant to disclose to the Tribunal particulars of other properties or assets owned by the 2^nd Defendant.

(c) The applicant bank shall file the latest memo of calculation of OA amount together with interest, costs etc., to be paid by the Defendants duly considering the amounts, if any, paid by the Defendant and/or amount realized by sale of assets etc., during the intervening period after the filing of the OA, enabling the Registry to prepare Recovery Certificate for the amount to be paid by Defendants to the applicant bank.

(d) The applicant bank shall file memo of costs within ten days from the date of this final order.

(e) Recovery Certificate shall be drawn up and issued to the Recovery Officer in terms of the final order.

A copy of this order be communicated to the parties concerned.
