(2) It was stated in the application that applicant had availed loan of Rs.1,47,63,056/from the respondents vide loan account No. 1651514; that on 27.03.2018 applicants availed top up facility from the respondents for a sum of Rs.35,21,873/- vide loan account No. 3956833 and loan agreement as well as other documents were executed and two properties mentioned in para 1 of the SA i.e., one residential property and other commercial property were mortgaged as security; that during the period of lock down due to Covid-19 Pandemic RBI issued regulatory package dated 27.03.2020 and in light of the guidelines applicants were entitled to moratorium period of three months for payment without interest and penalty charges; that again RBI issued another Covid-19 Pandemic regulatory package dated 23.05.2020 and in light of the guidelines applicants were entitled to moratorium period of further three months for payment without interest and penalty charges; that respondents have not given the benefit of above said regulatory packages to applicants; that after the opening of lock down the business of applicants has not comes on its wheels and due to this account of applicants became irregular; that after classifying the account as NPA in the month of September, 2020 respondents issued notice under Section 13(2) of the Act dated 19.09.2020 in respect of both loan accounts; that possession notice dated 10.12.2020 was issued by respondents; that above demand notice and possession notice was withdrawn by respondents themselves; that thereafter, with the consent of respondents, Sh. Sanjiv Jain husband of applicant No.2 sold the commercial property to Ms. Neha Jain on 12.01.2021 and out of sale consideration of Rs.95 Lacs, two cheques were given by the purchaser in the name of respondents amounting Rs.75,08,921/- and Rs.9,70,000/- and the same were received by respondents; that again notice under Section 13(2) of the Act dated 09.12.2021 was issued in respect of loan account No. 1651514 demanding total amount of Rs.85,93,314.04p; that reply to this notice/representation was sent by applicants to respondents on 07.02.2022; that respondents sent reply to the above representation of applicants on
