In this matter, the settlement has been arrived between the parties for an amount of Rs. 8.00 Lac out of which Rs. 1.50 Lac is being paid by cheque, balance amount be made by 10th December, 2025 and part payment will also be made in the middle of November, 2025. After the receipt of Rs. 1.50 Lac, the possession shall be handed back to the borrowers so that they can celebrate Diwali in their house.
The possession of the property shall be handed over through Court Receiver/ Advocate Commissioner and expenses of which shall be borne by the applicant herein. The receiver shall be entitled for the fee of Rs. 5,000/- along with travelling and miscellaneous expenses. Accordingly, Sh. Nirmal Verma (Mob. No. 9602981204), Advocate is appointed as Court Receiver. The Court Receiver shall be present at the premises along with Authorized Officer of the bank and borrower/ borrowers representatives. If the borrower/ applicant failed to make payment, the Court Receiver shall take the possession back from them.
In view of the above, this Securitization Application stands disposed of with liberty that in case of any exigency, concerned parties can move Misc. application.
