JUDGMENT

This Original Application was filed by the applicant bank on 23.10.2024 for recovery of outstanding amount of Rs. 20,17,184.87 from the Defendants.

As per the pleadings, Defendants approached the applicant bank in the year 2020 and requested to avail various loan facilities namely KGC Interest Subvention and Retail Agri Cash Credit Finance Facility under KGC Scheme. After due consideration, the applicant bank has sanctioned KGC Interest Subvention Finance facility on 12.08.2020 to the defendants for total limit to the tune of Rs. 1,45,000/- for a tenure of 12 months, the limit was renewable annually and the same was repaid along with 7% interest on half yearly basis. The applicant bank also sanctioned a Retail Agri Cash Credit Finance facility on 12.08.2020 for total limit to the tune of Rs. 14,23,000/- in favor of the defendants for a tenure of 12 months, the limit was renewable annually. And the same was repaid along with 13% half yearly interest.

Defendants failed to maintain financial discipline and committed defaults on regular basis on account of which the applicant bank issued recall notice under on 01.06.2024, but the defendants failed to clear the due amount therefore, the applicant bank has filed this original application for recovery of its dues against the Defendants.

Summons were issued to the Defendants on 23.12.2024 and affidavit of service has been filed by the applicant on 03.07.2025. As per the affidavit the defendants refused to

accept the summons, therefore, summons have been served through affixation on 18.06.2025 & 19.06.2025.

Heard arguments and perused the record.

As stated supra, the Applicant Bank filed the evidence affidavit of Sh. Gurpreet Singh Gambhir, coupled with the recitals in the documents, viz Exhibit AW/1 to AW/9 marked on behalf of the applicant bank, clinches the claim of the applicant bank against the Defendants. Hence, I hold that the Defendants are jointly & severally liable to pay to the applicant bank the claim made in O.A. with future interest and costs.

In the result, this O.A. No. 1437 OF 2024 is allowed declaring that:-

a) The Defendants are jointly & severally liable to pay to the applicant bank a sum of Rs. 20,17,184.87 (Rupees Twenty Lac Seventeen Thousand One Hundred Eighty Four and Eighty Seven Paisa only) with future interest @ 10.00% (simple) p.a. from 23.10.2023 till the date of realization.

b) The applicant bank is entitled to recover the above amount from the sale of the mortgaged property i.e. “1/7^th Share of Agricultural Property bearing Khata no. 47, Khasra no. 1010, 1045, 1094, 1099, 1131, 174, 246, 263, 264, 266, 267, 272, 364, 391, 393, 394, 432, 470, 472, 473, 59, 84 Village

Mehasra Khurd, Tehsil Dausa, District Dausa with total admeasuring area 4.29 Acres, owned by Jagdeesh Prasad Meena and personal movable and immovable properties/assets of Defendants. The applicant bank is entitled to proceed against the same towards recovery of its debt.

c) The applicant bank is entitled to the costs of the O.A.

The recovery certificate be issued forthwith and be sent to the Recovery Officer, DRT, Jaipur.

Parties are directed to appear before the Recovery Officer, DRT, Jaipur on 28.01.2026 .

10.Prepare Recovery Certificate accordingly.

11.A copy of the Judgment and Recovery Certificate be given or sent by registered post to each of the parties free. A copy of the Recovery Certificate be sent to the Recovery Officer of this Tribunal for necessary action as per the law.
