| During the course of argument in I.A. No.1441 of 2025, Ld. Advocate for the Applicant submits that the Applicant is apprehending that the Respondent may take the possession of his property being Survey No.21, Hissa No.2, CTS No.1048, Near Beach Rickshaw Stand, Gorai Village, Borivali West, Mumbai 400091 which was never mortgaged with the Respondent Bank. Ld. Advocate for Respondent Bank submits that Respondent Bank is not going to take possession of the above mentioned property and submits that as per the notice of Court Commissioner dated 08.05.2025, the Respondent Bank is going to take possession of the property i.e., Survey No.33, Hissa No.6, area admeasuring about 0-03-89 (H.R. Sq. Meter) and pot Kaharaba 0-00-25 (H.R. Sq. Meter) total area 0.04.14 |
