Ld. Advocate for the Applicant filed I.A. No.1275 of 2025 supported by affidavit (exhibit-8). Heard on I.A. No.1275 of 2025. During the course of arguments, Ld. Advocate for the Applicant submits that he wish to settle the matter with the Respondent. Accordingly, he has filed Undertaking-cum-affidavit (exhibit-9) stating that the Applicant undertakes to deposit Rs.11,40,000/- as about 20% towards the outstanding loan amount on or before 04.06.2025 by 1 o’clock and further undertakes to approach the Respondent Bank within 90 days to regularise his loan account and further undertakes to handover peaceful possession to the Respondent Bank in case of failure. So, in view of undertaking filed above, possession fixed for 04.06.2025 be deferred subject to condition mentioned in Undertaking-cum-affidavit (exhibit-9) failing which the Applicant shall handover the peaceful vacant possession of the subject flat to the Respondent and the Respondent would be at liberty to take appropriate measures under the SARFAESI Act.
