2' The averments made by the Appricant in brief are as folrows: Bandi Ganga Goud is the absolute owner of the schedule propert5r and the said Ganga Goud as proprietor of Ganesh Traders availed credit fac,ities to an extent of Rs.30 lakhs from the Respondent Bank in the year 2OlZ. Similarly M/s Narender Traders rep. by its proprietor viz., 3'a Appricant herein ava,ed credit facilities to an extent of Rs. 15 lakhs from the Respondent Bank and M/s Sri Sai Traders rep.by its proprietor Bandi Devender Goud, i.e. 2d Applicant herein availed credit facilities to an extent of Rs.15 lakhs from the Respondent Bank. The said Ganga Goud created mortgage in respect of the schedule propert5r towards common securit5r for the above referred loan facilities. The said Ganga Goud died on 22.12.2O1g leaving behind the Applicants as legal heirs. Initially, the Bank issued demand notice dt.24.l,.2,lgand possession notice dt.l4.0l.2O2O in respect of the schedule property. Thereafter, the Bank also issued e Auction Sale Notice dt.22.O2.2O22, suppressing the death of the Ganga Goud. The 4tr, Applicant challenged the proceedings initiated by the Respondent bank against the schedule property by filing writ petition and the same was allowed by giving liberty to the Respondent bank to proceed afresh. Thereafter, the Respondent bank issued fresh demand notice dt. 14.0 9.2021 to the Applicants and the Applicants submitted objections dt.l2.ll.2O2l u/s 13(3A) ofthe Act and to the said objections, the Respondent issued reply on 26.11.2021. Thereafter, the Respondent bank issued possession notice dt'20'12'2021 and subsequently issued e Auction sale Notice dt.22.I2.2O22 for conducting auction of the schedule propert5r on 3O.O 1.2023.
