a) A sum of Rs.42,77,435/- with current and future interest @ lL.40o/o p.a with monthry rests from 20.05.2024 tiil the date of realization.

b) A sum of Rs.1,48,855/- with current and future interest @ 10,90olo p.a with monthry rests from 20.05.2024 tiil the date of rearization. And in default for sale of mortgaged property as mentioned in the schedule to OA.

As per the averments in the apprication, the Appricant Bank states that defendant availed housing loan of Rs.20,20,000/_ and funding of home loan insurance for a sum of Rs.16,450/_ aggregating to Rs.20,36,450/- on 29.12.20L7. As security towards repayment of housing roan, the defendant executed agreement to mortgage dated 28.12.20L7 and agreed to create mortgage of schedule property. After availing the loan facirity, the defendant faired to compry the terms of sanction, hence the applicant bank classified the account as NpA on 22.04.2023 and issued legal notice dated t2.03.2024. Inspite of severar requests and demands, the defendants did not crear the outstanding. Hence this OA.

The point that arise for consideration is whether the Applicant Bank is

entitled for the claim made in the OA against the Defendant as prayed

for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited rerevant documents as Ex.A1 to A.18. In view of the above, I hord that the Appricant Bank has estabrished their craim made in the OA against the Defendant and hence the Applicant Bank is enti'ed to recover the craim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under:

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.44,26,29Ol-(Rupees Fofi Four Lakhs Twenty Six thousanct Two Hundred and Ninety only) i.e.,

a) A sum of Rs.42,77,435/- with current and future interest @ 71.40o/o p.a from 20.05.2024 till the date of realization.

b) A sum of Rs.1,48,855/- with current and future interest @

The defendant is entifled to proceed against the mortgaged property as mentioned in the schedule to oA towards realization of the debt due.

10' The Appricant Bank is arso entifled to proceed against the person and properties of defendant towards realization of the debt due.

The Applicant Bank is entifled to the costs of the OA.

The Applicant shail fire a cost memo within two weeks from the date of receipt of order.

Issue Recovery certificate accordingly.

Communicate a copy of the order to the parties concerned.
