The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.24,78,868/- (Rupees Twenty Four Lakhs Seventy Eight Thousand Eight Hundred and Sixty eight only) with interest @ t7.25o/o p.awith monthly rests plus penal interest @ 2o/o p.a frcm 04.12.2024 ill the date of realization.

As per the averments in the application, the Applicant Bank states that defendant availed personal loan facility under Express credit Elite scheme of SBI for a sum of Rs.25.00 lakhs vide letter of arrangement dated 11.07.2023. The defendant agreed to repay the loan amount with interest @ 11.650lo p.ain 72 EMIs. The defendant executed all necessary loan documents. After availing the loan facility, the defendant failed to comply the terms of sanction, hence the applicant bank was constrained to crassify the account as NpA on 09.09.2024 and issued notice dated 05.09.2024. Inspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Sri l. Rama Rao, Chief Manager of the Applicant Bank examined

himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.5.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is

entitled for the claim made in the OA against the Defendant as prayed for?

7 ' Defendant caled absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and she exhibited relevant documents as Ex.A1 to A.5. In view of the above, I hord that the Appricant Bank has estabrished their claim made in the OA against the Defendant and hence the Applicant Bank is entitred to recover the craim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under:
