2' As per the averments in the apprication, the Appricant Bank states that defendant avaired personar roan facirity under xpress credit Erite scheme of SBI for a sum of Rs.8,93,400/_ vide letter of arrangement dated 24.02.2023. The defendant agreed to repay the loan amount with interest @12.50o/o p.a and the loan amount was repayable in 72 EMIs of Rs.t7,7OO/- per month. After availing the loan facility, the defendant failed to comply the terms of sanction. hence the applicant bank was constrained to crassify the account as NpA and issued regar notice dated 23.07.2025. Inspite of severar requests and demands, the defendant did not clear the outstanding. Hence this OA.

The point that arise for consideration is whether the Applicant Bank is

entitled for the claim made in the OA against the Defendant as prayed for?

Defendant called absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and she exhibited rerevant documents as Ex.A1 to A.14. In view of the above, I hord that the Appricant Bank has estabrished their claim made in the oA against the Defendant and hence the Applicant Bank is entifled to recover the craim made in the oA with Future interest and costs.

B. In the result, the present OA is allowed with costs, as under: The Defendant is riabre to pay to the Appricant Bank a totar sum of Rs.28,16,538/- (Rupees Twenty Eight Lakhs Sixteen Thousand Five Hundred and Thirty Eight only) (Rs.LO,29,9L2/- + Rs.L7,g6,626/ -) with further interest @ 14.50o/o p.a from date of filing of OA till the date of realization.
