No. 7337001800038101 with future interest @9.25Vo p.a. from the defendants jointly and severally from the date of apptication till the date of realization along with costs and in default for sale of OA schedule properties.

Summons served on D1 to 3 through paper publication. They were set ex-parte on 22.08.2025 as called absent and no representation.

The Applicant Bank examined Ganesh Kumar A, Branch lYanager, as AW-1 and marked 63 documents through him as Ex. A.1 to Ex. A.63.

Heard the Ld. Counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entiued for the claim made in the OA against the Defendants and OA schedule properties?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.63 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are joinly and severally liable t </,

to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.446/2025 is allowed as under: -

i) The Defendants are^jointly and severally llable to pay to the Applicant Bank a total sum of Rs.2,69,00,265.26ps i.e., a sum of Rs.2,74,74,433.46ps towards Over Draft A/c. No.7337000600021501, a sum of Rs.3l ,72,21,9.02ps towards Quick Loan-DPN Non-El.4I A/c. No.7337OO74O001,57 01 and a sum of Rs.22,53,612.78ps towards Working Capita I TL-GECL-Scheme A/c. No. 7337001800038101; with future interest @10.15o/o^p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debu
