The Appticant Bank filed the present OA for the recovery a total sum of Rs.4,g2,O 3,433.67ps i.e., a sum of Rs.75,87,632.49ps towards Vehicte Loan_I A/c. No.04 ggtOOB7B4O4, a sum of Rs.75,97,632.49ps towards Vehicle Loan_II A/c. No. 0499100878416, a sum of Rs.26,77,638.73ps towards Vehicte Loan UI A/c. No. O 4ggtOOg7B4ZA, a sum of RS.7S,B7,632.4gps towards vehicle Loan-IV A/c.No.0 4g970t763646, a sum of Rs-75,A7 ,632.49ps towards Vehicle Loan-V A/c. No. 0499101763658, a sum of Rs.75,87,632.49ps towards Vehicle Loan-VI A/c. No.0499101763660 and a sum of Rs.75,87,632.49ps towards Vehicle Loan-ViI A/c. The Applicant Bank examined Srinivas Behara, Vice president, as AW-1 and marked 21 documents through him as Ex. A.1 to Ex. A.21.

Ld. Counsel for the Applicant Bank reported orders may be

passed through merits. perused the material placed on record.

the Defendants and OA hypothecated assets?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.21 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.931/2025 is allowed as under: -

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.4,82,03,433.67ps i.e., a sum of Rs.75,87 ,632.49ps towards Vehicle Loan-I A/c. No.0499100878404, a sum of Rs.75,87,632.49ps towards Vehicle Loan-II A/c. No. 0499100878416, a sum of Rs,26,77 ,638.73ps towards Vehicle Loan III A/c. No.0499100878428, a sum of Rs.75,87,632.49ps towards Vehicle Loan-IV A/c. No.0499101763646, a sum of Rs.75,87,632.49ps towards Vehicle Loan-V A/c. interest @9.760/o p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of hypothecation of assets described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entitled to proceed against the person and properties of defendants for realization of its dues;

iv) the appllcant bank is entitled for the costs.

B. The Applicant Bank is directed to file Cost Memo within 2 weeks from the date of receipt of this Order.

Issue Recovery Certificate accordingly.
