ORDER
- The Applicant Bank fired the present oA against Defendants for recovery of a total sum of Rs.88,27,973/-. (Rupees Eighty Eight Lakhs Twenty Seven Thousand Eight Hundred and Seventy Three Only) with future interest @ 1O.gO% p.a with monthty rests from the date of this application till the date of realization.
..2. As per the averments in the application, the Applicant Bank states 6$ ant no. 1 is the private limited company and .2 is the Managing Director and Defendant no.3 is 2-5 /tjiii., jrrffircs1$ of Defendant No.'1. The Applicant Bank contended

that defendant no. 1 availed rerm loan of Rs.90.00 Lakhs with interest @10.90% p.a repayable in 90 monthly instalments of Rs.1,00,000/- and cash credit Loan of Rs.5 Lakhs with interest @10.90% p.a with monthly rests repayabte in s4 EM! of Rs.52,356/- and executed Agreement of Loan cum Hypothecation dated 01.07.2023 in favour of the applicant bank. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued Demand notice on. 01 .09.2022 and 06.10.2022. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this oA.
Defendants No. land 3 called absent and set exparte on 04.08.2025. Notice not taken against the Defendant No. 2 by the bank hence the claim of the Bank against Defendant no. 2 is dismissed.

The Defendants No. 1 and 3 are joinfly and severally liable to pay to the Applicant Bank a total sum of Rs.88,27,g73/-. (Rupees Eighty Eight Lakhs Twenty Seven Thousand Eight Hundred and Seventy Three Only) with future interest @ 10.90% p.a from the date of this application till the date of realization. (Claim against Defendant No. 2 is dismissed as notice not taken by the bank).
