As per the averments in the application, the^{ApplicantBank states} that Defendant no. 1 availed loan of Rs.9.00^{Lakhs/- along with} interest, cost,^penal interest, etc. and created^{mortgage morefully} described to Schedule to OA by deposit^{of Title deedson} 29.07.2009 in favour of the applicant bank.^{The Defendants} availed Cent Mortgage Over Draft Credit facility^{of Rs.13,40,0001} with interest @14o/o^p.a along wllh^{2o/o penal interestand created} mo$.g.iqie morefully described to Schedule I^{to OA by deposit of} Title d€eds on 29.07.2009 in favour of the^{applicant bank. Schedule ll to OA by deposit of Title deeds on 29.07.2009ⁱⁿ favour of the applicant bank. The Defendants^{availedcredit} facility of Rs.12.00 Lakhs with interest @8.50%^{p.a repayable in} 120 months with 36 monthly installments and executed^Term Loan Agreement dated 28.10.202 in favour of the applicant^bank. The said lon facilities were renewed and enhanced^{from time to} time by the defendants. After availing the loan^{facility, the} defendants failed to comply the terms of sanction, hence^the applicant bank classified the account as NPA on 28.02.2023 and issued Legal notice on 23.10.2024. lnspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Defendants called absent and set exparte on 16.10.2025.

Sri. Yadav Myakala, Authorized Signatory of the^{ApplicantBank} examined himself as AW.1 and exhibited relevant^documents, which are marked as Ex.A.1 to A.37.

A.37. ln view of the above, I hold that the Applicant^Bankhas established their claim made in the OA^{against the Defendants} and hence the Applicant Bank is entitled to^{recover the claim} made in the OA with future interest^{and costs.}

ln the result, the^present OA is allowed^{with costs, as under:}

The Defendants No. 1 and 2 are^{jointly and} severally^{liable to pay} to the Applicant Bank a total sum of Rs.52,78,094.79^Ps. (Rupees Fifty Two Lakhs Seventy Eight Thousand Ninety Four and Paise Seventy Nine Only) i.e a sum of -

The Applicant Bank is also entitled to proceed against the person and properties of defendants No. 1 and 2 towards realization of the debt due.

That Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.
