The Applicant Bank filed the^present OA against Defendants for recovery of a total sum of Rs.31,61,536/-.^(Rupees Thifi One Lakhs Sixty One Thousand Five Hundred and Thirty six Only) i.e a sum of -

(i) Rs.10,64,989/-. (Rupees Ten Lakhs Sixty Four Thousand Nine Hundred and Eighty Nine Only) with future^interest @ 14.15o/o p.a with monthly rests from the date of this^application till the date of realization.

(ii) Rs.20,96,547/-. (Rupees Twenty Lakhs Ninety Six Thousand Five Hundred and Forty Seven Only)^{with future} interest @ 14.15%o^p.a with monthly rests from^{the date of this} aoolicatioh:till the date of realization.

As per the averments in the application,^{the ApplicantBank states} that defendant no.2 is the Director of^{Defendant No. 1 availed} Cash Credit toan limit of Rs.10.00^{Lakhs with interest} @14.15o/o p.a with monthly rests and Term Loan of Rs.28 Lakhs^{with interest} @^{14.15o/op.a with monthlyrests repayable in 54EMI of} Rs.52,356/- and executed Agreement^{of Loan cum Hypothecation} dated 17.10.2022 in favour^{of the applicant bank. After availing} the loan facility, the defendants^{failed to comply the termsof} sanction, hence the applicant^{bank classified the account as NPA} and issued Legal notice on^{14.08.2025.lnspite of several} requests and demands, the^{defendants did not clearthe} outstanding. Hence this^OA.

Sri. B. Harindranath^{Bagalkote, Manager of the ApplicantBank} examined himself as^{AW.1 and exhibited relevant documents,} which are marked as^{Ex.A.1 to A'12.}
