The Applicant Bank filed the^present OA against Defendant^for recovery of a total sum of Rs.24,67,639/-^(Rupees Twenty^Four Lakhs Sixty Seven Thousand Six Hundred and Thirty^Nine Only) i.e a sum of -

(ii) Rs.15,29,933/- (Rupees Fifteen Lakhs Twenty Nine Thousand Nine Hundred and Thirty Three Only) with future interest @ 12.60%^p.a with monthly rests from the date of this application till the date of realization;

(ii) Rs.9,33,706/- (Rupees Nine Lakhs Thifi Three Thousand Seven Hundred and Six Only) with future interest @ 12.50Yo p.a with monthly rests from the date of this application till the date of realization;

As per the averments in the application, the Applicant^{Bank states} that Defendant availed Personal Loan under Xpress Credit^of Rs.20.00 Lakhs with an interest @^12.600/op.a with^monthly rests repayable in 72 EMI of Rs.37,660/- each and^executed Personal Loan Agreement on 25.08.2021^{. The Defendant availed} Personal Loan under Xpress Credit of^{Rs.10.00 Lakhs with an} interest'.@ 12.50o/o^p.a with monthly^rests repayableinT2^EMlof Rs.18,779/+ each and executed Personal^{Loan Agreementon} 17.V2.2023.' After availing the^{loan facilities,the defendantfailed}

to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued Legal notice on 19.07.2025. lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this OA.

Defendant called absent and set exparte on 07.10.2025.

Sri. Ganji Prasad, Chief Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are marked as Ex.A.1 to A.10.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant bank is entitled for the claim made in the OA against the Defendant as prayed for?

hence the Applicant Bank is entitled to recover the claim madeⁱⁿ the OA with future interest and costs.

ln the result, the present OA is allowed with costs, as under^:

The Defendant is liable to pay to the Applicant Bank a total sum of Rs.24,67,639/- (Rupees Twenty Four Lakhs Sixty Seven Thousand Six Hundred and Thirty Nine Only) i.e a sum of -

(ii) Rs.15,29,933/- (Rupees Fifteen Lakhs Twenty Nine Thousand Nine Hundred and Thirty Three Only) with future interest @ 12.600/o p.a with monthly rests from the date of this application till the date of realization;
