The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.27,12,294/- (Rupees Twenty Seven Lakhs Twelve Thousand Two Hundred and Ninety Four Only) with future interest @ 13.50% p.a from the date of filing of this application till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant's husband Late. Nurubasha Mohinuddin availed personal loan under Xpress Credit Facility under Term Loan of Rs.10.00 Lakhs repayable in 72 equal monthly installments of Rs.19,2921 pm. Together with interest @ 11.50% p.a and executed Personal Loan Agreement on 30.05.2023 in favor of the applicant bank. The defendant's husband Nurubasha Mohinuddin availed another personal loan under Xpress Credit Facriity under Term Loan of Rs.13,50,000/- on 08.06.2023 repayable in 72 equal monthly installments of Rs.26,044/- pm. together with interest @ 11.50% p.a and executed Personal Loan Agreement on 08.06.2023 in favor of the applicant bank. The Applicant Bank contended that Nurubhasha Mohinuddin died on 1.2024 and the defendant is the legal heir of the deceased After availing the loan facilities, the Nurubasha to comply the terms of sanction, hence the the account as NPA on 07.04.2024 and

issued legal notice on 15.04.2O2S.lnspite of several requests and demands, the defendant did not clear the outstanding. Hence this oA.

Der^ndant called absent and set exparte on 10.09.2025.

Sri, Govind Raju Katta , Manager of the Applicant Bank examined himself as AW.1 and exhibited relevant documents, which are nr;,,red as Ex.A.1 to A.11.

To substantiate the case of the Arpiicant Bank, AW.1, officiat of the Appticant Bank was e^-,nined and he exhibited relevant documents as Ex.A.1 to A.11. ln view of the above, I hotd that the Appticant Bank has e-.-.)lished their claim made in the OA against the Defendant and h-,,ce the Applicant Bank is entitled to recover the claim made in ti -. JA with future interest and costs.
