The Applicant Bank filed the present OA against Defendant for recovery of a total sum of Rs.24145,L76/- (Rupees Twenty Four Lakhs Forty five Thousand one Hundred and seventy six only) with future interest @ 13.80% p.awith monthly rests from 22,05.2025 till the date of realization.

As per the averments in the application, the Applicant Bank states that defendant availed Xpress Credit Loan facility under Term loan for a sum of Rs.24.50 lakhs vide its arrangement letter dated 12.10.2023 and agreed to repay a sum of Rs.47,6441- per month from the salary from the month Nov'2023 onwards. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NpA and legal notice was issued on 28.12.2024 and 16.01 .zo2s. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is

entitled for the claim made in the OA against the Defendant as prayed for?

Defendant remained exparte. To substantiate the case of the Applicant Bank, AW.1, officiar of the Appricant Bank was examined and she exhibited rerevant documents as Ex.A1 to A.g. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendant and hence the Applicant Bank is entitled to recover the craim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under:

The Defendant is liable to pay to the Applicant Bank a total sum of Rs,24,45,176/- (Rupees Twenty Four Lakhs Forty five Thousand One Hundred and Seventy Six only) with future interest @ 13.80o/o p.a from 22.05.2025 till the date of rea lization ;
