ORDER

The Applicant Bank fired the present oA against Defendants for recovery of a total sum of Rs.22,42,144l- (Rupees Twenty Two Lakhs Forty Two Thousand Seven Hundred and Forty four

only) with future interest @ 14.55o/o p.a from date of application till the date of realization.

As per the averments in the apprication, the Appricant Bank states that Defendant No.1's husband Sri paga Ashok Kumar (died) availed term roan of Rs.10.00 rakhs on 12.09.2023 and agreed to repay in 72 EMIS with an installment of Rs.19,g3g/_ per month. subsequently the deceased borrower also availed credit facility of Rs.14,54,000/- on 10.10.2022. After availing the loan facilities, the defendants faired to compry the terms of sanction, hence the applicant bank crassified the account as NpA and issued regal notice dated 12.02.2025. Inspite of several requests and demands, the defendants did not crear the outstanding. Hence this oA.

Sri M. Ravinder, Manager of the Applicant Bank examined himself as AW.l- and exhibited relevant documents, which are marked as Ex.A.1to A.12.

Heard the Ld. Counsel for the Applicant Bank.

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the OA against the Defendants as prayed for?

Defendants remained exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A.12. In view of the above, I hold that the Applicant Bank has established their claim made in the OA against the Defendants and hence the Applicant Bank is entitled to recover the claim made in the OA with future interest and costs.

B, In the result, the present OA is allowed with costs, as under: The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.22,42J44/- (Rupees Twenty Two Lakhs

The Applicant Bank is also entifled to proceed against the person and propertles of defendants towards realization of the debt due. However the applicant bank is entiiled to proceed against the estate devolved upon the defendants from the deceased latepaga Ashok ku ma r.

The Applicant Bank is entitled to the costs of the OA.

The Applicant shall file a cost memo within two weeks from the date of receipt of order.

Issue Recovery certificate accordingly.

Communicate a copy of the order to the parties concerned.
