As^per the averments^{in the application,the Applicant Bank states that} Defendant no.1 availed^{personal loan of Rs.18,78,000/- under Xpress} Credit on Ol.LO.2022 and^{executed personal loan agreement,consent} letter dated 30.O9.2022 and agreed^{to repay in 72 EMIs @ Rs'36,521l-} with interest at 11.80o/o^p.a with monthly rests.^{Defendantno.2 is} the proforma party. Defendant no.1 applied for^{VRS, hence the} applicant bank sought for credit of his terminal benefits to SB account with the Applicant bank. After availing the loan facility, the defendant No.1 failed to comply the terms of sanction, hence the applicant bank was constrained to classify the account as NPA on 30.06.2024 and issued legal notice dated 15.05.2025. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this oA.

Defendant called absent and set exparte on 06.08.2025.

Mrs. Geetha Lakshmi, r of the Applicant Bank examined herself as AW.1 and uments, which are marked as Ex.A.1 to A. r,?

The point that arise for consideration is whether the Applicant Bank is entitled for the claim made in the OA against the Defendant as prayed for?

Defendant No.1 called absent and set exparte. To substantiate the case of the Applicant Bank, AW.1, official of the Applicant Bank was examined and he exhibited relevant documents as Ex.A1 to A. 14. In view of the above, I hold that the Applicant Bank has established their claim made in the oA against the Defendant and hence the Applicant Bank is entitred to recover the claim made in the oA with future interest and costs.

B. In the result, the present OA is allowed with costs, as under: The Defendant No.1 is riabre to pay to the Appricant Bank a totar sum of Rs.3O,7O,224 / - (Rupees Thirty Lakhs Seventy Thousand Two Hundred and twenty four only) i.e,

a) A sum of Rs.18,72,087/- with further interest @ 13.g0o/o p.a from date of filing of OA till the date of realization;

b) A sum of Rs.11,98,137/- with further interest @ 13.55o/o p.a from date of filing of OA till the date of realization;

The Applicant Bank is arso entiued to proceed against the person and properties of defendant No.1 towards realization of the debt due.

The Applicant Bank is entifled to the costs of the OA.

13, The Applicant shall file a cost memo within two weeks from the date of receipt of order.

Issue Recovery certificate accordingly.

Communicate a copy of the order to the parties concerned.
