The Applicant pank filed the present OA against Defendants for 2 tetble of a total sum of Rs.24,37,548/ - (Rupees Twenty Four 'sRABA RUN

Lakhs Thirty Seven Thousand Five Hundred and Forty Eight only) with future interest @ 9.05% p.a from 09.05.2025 till the date of realization and in default for sale of mortgaged property as mentioned in the schedule to OA.

As per the averments in the application, the Applicant Bank states that Defendant no.1 is the son of defendant no.2 who availed housing loan for a sum of Rs.25.00 lakhs for construction of house and agreed to repay in 240 EMIs @ Rs.22,383/-. The defendants executed composite agreement and created equitable mortgage of schedule mentioned property and deposited the original deed no.3493/2018 dated 11.06.2018. After availing the loan facility, the defendants failed to comply the terms of sanction, hence the applicant bank classified the account as NPA and issued demand notice dated 6.10.2023. Inspite of several requests and demands, the defendants did not clear the outstanding. Hence this OA.
