The claim of the bank is to the tune of Rs. 85,89,343.44/- with interest & cost.

COMPROMISE

The borrower has agreed to deposit an amount of Rs. 29,00,000 (Rupees Twenty Nine Lac) as full and final settlement of the dues. The bank authority and the borrower have agreed voluntarily with full consent to receive that amount by the bank and to give that amount by the borrower. The applicant bank states that they have agreed to receive an amount of Rs. 29,00,000 (Rupees Twenty Nine Lac) as full and final settlement as per under noted terms: -

Down Payment: - Rs. 6 Lac through Cheque dated 14.11.2025. Installments: -

a) Rs. 5 Lac till 31.12.2025. b) Rs. 5 Lac till 31.01.2026. c) Rs. 5 Lac till 29.02.2026

d) Rs. 8 Lac till 14.03.2026.

It is stated that borrower does not owe any further amount to the bank in respect of the above accounts after above payment.

In case of default, borrower is liable for O.A. amount with interest less recoveries made.

The request for return of original documents as per rules, permitted. Since the matter is before the Lok-Adalat complete court fees be refunded to the applicant bank.

The above settlement is agreed upon before the Panel and the same is verified in the light of the contents of compromise pursis dated 14.11.2025.

ORDER/AWARD

In view of the above settlement and payment in the present matter before LokAdalat, the award is passed. The interim relief, if any, stands vacated. The Original Application no. 1083/2023 stands disposed of accordingly.

Refund of complete Court fees is ordered to be paid to the Bank after acknowledgement of the same. In case of failure, Bank/FI can move application for issuance of Recovery Certificate on the basis of this Award.
