| On 31.01.2022, it had granted a loan of Rs.26.80Lacs in the form of Term |
| Loan Facility for business purpose. The loans were chargeable different |
| rates of interest. To secure the loan, Defendant no. 2 extended mortgage |
| over the property (fully detailed in para no.3A of the application). |
| Defendant nos. 2 and 3 stood as the guarantors. Besides the OD Limit and |
| Term Loan (BGECL), Bank had granted a loan of Rs.2,86,207/- in the |
| form of Personal Loan to Defendant no.1. On 12.03.2024, total sum of |
| Rs.1,36,02,270.72p was due from the defendants. Despite repeated |
| requests, defendants did not make the repayment. Hence, this application. |
3. On 30.07.2024, summonses were sent to the defendants by |
registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 03.07.2025, they were proceeded_ex parte_. |
4. In order to prove its case, the Bank has placed on record the |
| affidavit of Sh. Digvijay Singh Negi, Authorized Officer along with the |
| loan and security documents and marked them as Exhibit A-1 to A-32. |
5. I have perused the evidence on the record. I am of the considered |
view that the Bank has proved its case that it had advanced the loans under various schemes and on 12.03.2024, a sum of Rs.1,36,02,270.72p was due. |
6. Accordingly, the application of the bank for the recovery of |
| Rs.1,36,02,270.72p (Rupees One Crore Thirty Six Lacs Two Thousand |
Two Hundred Seventy and Paise Seventy Two Only) i.e. |
| Rs.1,08,11,286.29p with interest @12.90% per annum with monthly rests; |
| Rs.24,84,458.56p with interest @8.75% per annum with monthly rests; |
| RS.3,06,525.87p with interest @8.40% per annum with monthly rests, |
from 03.05.2024 till the date of payment is hereby allowed with costs. The liability of all the defendants would be joint and several. Bank can recover |
