Application for restoration of T.O.A. No.38 of 2023. Ld. Advocate for the Applicant submits that the above T.O.A. was listed before the Hon’ble Presiding Officer on 12.06.2023 for passing order for issuance of summons. On the said date, the advocate for Bank due to oversight missed out in attending the matter and hence, the matter was transferred to the board of Ld. Registrar. Ld. Advocate further submits that the matter was transferred before the Ld. Registrar for filing undertaking that they will appear henceforth without further delay. The T.O.A. was listed on the board

Registrar on 08.02.2024 and on the said date, the Applicant did not remain present due to which the matter was again transferred to the board of P.O. for necessary orders and the matter was adjourned on 15.05.2024. On 15.05.2024, T.O.A. No.38 of 2023 was dismissed as the Applicant failed to comply the order.
rst - 09	Hence, the Applicant prays for restoration of the T.O.A. No.38 of 2023. In the above facts and circumstances of the case, M.A. No.80 of 2024 is allowed subject to cost quantified in the sum of Rs.5000/- payable to DRT Bar Association for purchase of books and periodicals.
