In this matter, Counsel for the applicant seeks no instructions, however, the counsel for the bank argues that the orders in the MA passed on the date 07.10.2022 was obtained by misrepresentation and fraud and this has also been recorded in the order of the Hon’ble DRAT.
In view of this, Counsel for the Respondent submits that this MA may be dismissed with heavy cost.
Accordingly, a cost of Rs. 5,000/- is being imposed on the applicant to be paid to DRT Bar Association. Counsel for the applicant is directed to intimate the applicant about this order.
With these directions, MA stands disposed off, all pending IAs also stands disposed off, if any.
