This Misc. Application has been filed for restoration of the Securitization Application no. 120/2019, as this SA was dismissed two years back. Counsel for the applicant seeks restoration on the ground that earlier counsel has pleaded no instruction and has not appeared. According to the counsel for the respondent bank, there is no explanation as to the delay being caused, therefore, he opposed restoration of this SA. He submits that the bank has not proceed as of today for the recovery of the amount.

Subject to deposit Rs. 5.00 Lac by the applicant with the respondent bank within 30 days from today, SA no. 120/2019 will be restored. The applicant to place on record proof of deposit of Rs. 5.00 Lac before the Ld. Registrar and only after filing of proof of deposit of amount, this SA shall restore. Accordingly, this Misc. Application stands disposed of.
