Counsel for the applicant has filed this Misc. Application in OA no. 393/2017 which was decided by this Tribunal on 08.08.2019 and she submitted that the applicant bank has recovered an amount of Rs. 21,20,000/- from auction of the mortgaged property under Securitization Act and thereafter during the pendency of the Recovery Certificate, compromise was arrived between the bank the borrower/defendants, wherein the remaining due loan amount was settled with condition to deposit lump-sum amount of Rs. 2,10,000/- in the loan. In pursuance of the settlement the defendants/borrowers have deposited OTS amount and account was closed on 07.02.2025, therefore, she prayed that the recovery proceedings pending before the Ld. Recovery Officer in Recovery Certificate No. 773/2019 may kindly be closed and return the original title documents.

The Ld. Recovery Officer is directed to close the proceedings of Recovery Certificate No. 773/2019 and Registry is directed to return the original documents to the Authorized Officer of the applicant bank after acknowledgement of the same.

Accordingly, file of Misc. Application and Recovery Certificate be consigned to record.

Copy of order be uploaded on website and sent to the Ld. Recovery Officer.
