The Applicant by explaining her problems, requested the Respondent Bank for restructuring of loan but, the Respondent Bank proceeded for sale of the schedule property by issuing Sale Notice dt.24.Ol.2o2l, fixing the auction on 25.02.2021. The Applicant, challenging the said action of the Respondent Bank, filed SA.No' 1 1 I 2021 before this Tribunal and obtained conditional stay orders. Though the Applicant complied with part of the said conditional stay order by depositing Rs.4.50 lakhs, she could not comply the said order fully as she was hospitalized. However, the Respondent Bank in the said SA.No. 1 I l2o2l, filed a Memo stating that the auction of the schedule property was not successful for want of bidders. Subsequently, the Applicant was surprised to see Sale Notice dt. 12.01.2022, which was affxed on the schedule property, wherein the auction date of the schedule property was fixed on 25.02.2022. Later on, the Respondent Bank filed a Memo in the said SA.No. 1ll2o2l, wherein it is stated that auction of the schedule property was successfully conducted on 25.O2.2022. So, challenging the said action of the Respondent Bank, the present SA is filed.
