MA. 07/24 is an application by the petitioner Bank to correct the schedule to the o'A. and Rc by substituting "4.26 sq.meters of undivided share of land in common areas as "30.15 sq.yds equivalent to 25.21 sq.mts of undivided share of land in common areas.

Heard Ld. Counsel for the petitioner Bank and perused the record.

It is the submitted by the petitioner Bank that oA 49gl19 was alowed vide orders dt.29 'og '2027 and accordingry, Recovery certificate was arso issued. However, it is later observed that to a crericar mistake in the oA schedure, it was wrongry mentioned as 4.26 sq.mts of undivided share of rand in common areas instead of "30.15 sq.yds uirlFnt to 25.21 sq.mts of undivided share of land in common areas. was correctly mentioned in the sanctioned plan dt.16.0 GHlvlc. The defendant No.4 also issued a letter dt.04 4 ng istake happened in the schedule property and ule as original sanction plan physicalfeatu res of the ing other details of the schedule property.

In view of the above facts and circumstances of the case, M.A.7/24 is alowed and the Petitioner Bank is hereby directed to amend the oA schedure as prayed for. upon amendment of oA schedure, Registry is directed to issue amended Recovery certificate by modifying the schedure of property in R.C.No.104/2022 as..30,15 sq'yds equivarent to 25.21 sq.mts of undivided share of tand in common areas" in prace of 4.26 sq.mts. of undivided share of rand in common areas.
