The point that arises for consideration is :

Whether the Applicant Bank is entifled to the clajm made in the OA against the Defendants and OA schedule properties as prayed for?

As stated supra, the Defendant remained absent and did not turn up to controvert the version of the O.A, of Applicant Bank. The Evidence Affidavit coupled with the recitals in the documents viz., Exhibits Annexure-A-1 to Annexure-A-11 marked on behalf of the Applicant Bank, established the claim of the Applicant Bank against the Defendants and OA schedule properties, Hence, I hold that the Defendants are jointly and severally liable to pay to the Applicant Bank the claims made in the OA with future interest and costs.

In the result, the present Original Application is allowed ex-parte with costs, as under:-

ORDER

(1) O.A. No, 492 of 2022 filed by the Applicant Bank is allowed and debt is determined with cost against the defendants. It is hereby ordered that applicant bank is entitled to recover^from the defendants the total amount to the tune of Rs. 26,96,365/-^{( Rupeestwenty six lakh}

J ninety six thousand three hundred sixty^five ) only^{with pendentelite and future interest@} 7,7|o/o^pet annum interest with simple^{on theamountdue from the dateof filing of the} Original Application i.e. on 5/08/2022^{till full andfinalrealization of the claimamoLrnt}

(2) Amount, if any,^paid by the defendants^{in the loan accountsor amount, if any, recoveredby} the Applicant Bank after^{filing of theO.A. the same be taken intoaccountwhile arriving at} the exact amount of dues/debt^{payableby the defendants.Accordingly, pendentelite and} future interest shall be^{calculated on the reducedamount.}

(3) Defendants are debarred^{from disPosing,alienatingor dealingwith anyof theproperties} belonging to them till^{the aforesaid decretal debt is recovered from the defendants}

(4) Defendants are^{given a time of thirtydaysfrom the date of the Judgement/Final Orderfor} repaying of the above^{mentioned dues, so intimated to them ln casethe defendantsfail to} pay the dues within the above^{mentionedtime, the applicant bank is entitledto recoverits} dues by sale of secured^{assets, if any. Applicant bank is also entitled to proceed against} personal properties of the^{defendants(Bothmovableand immovable)and alsoproceed} against the defendants^{personallyto recover the dues in accordance with law'}

(s) Let the Certificate of^{Recoverybe drawn up by Ld Registrar forthwith in terms of} ludgement^{for issuanceof thesame against defendantsin favourof theapplicantbank} underSectionlg(22)oftheRecoveryofDebtsandBankruptcyAct,lgg3andputUpthe same for issuance^{of the Certificate.}
