The Applicant Bank filed the^present OA being No. O.A. 185 of^{2024 on210312024lot} recovery of a total sum ol Rs. 72,02,394.21/-^(Rupees seventy^{two lakh two thousand} three hundred nlnety four and^paise twenty^{one only)from} the^{Defendantstowards term} loan toqether with interest, cost and other usuat reliefs.

The Defendants are served with summons. The defendants did not appear,^{as there wasno} representation from the defendants, the case^{was fixed for ex-parte hearing on 5lO9/2O24,} and heard ex-Parte accordingly.

Heard the Ld. Counsel^{for the Applicant Bank'}

The point that arises^{for considerationis:}

whether the Applicant^{Bank is entitled to the claim made in the OA againstthe Defendants} and OA schedule^{properties as prayed for?}

As stated supra,^{the Defendant remained absentand did not turnup to controvert the} version of the O.A. of^{Applicant Bank. The EvidenceAmdavit coupled with the recitals in the} documents viz',^{Exhibit Annexure A to AnnexureM marked on behalfof the ApplicantBank,} establashed the^claim of^{the Applicant Bank against the Defendantsand oA schedule} properties. Hence, I hold that^{theOefendants are} iointly^{and severally liable to pavto the} Applicant Bank the^{claims made in the OA with future interest and costs'}

(1) O.A. No. 185 of 2024 fied bv^{the Applicant Bank is allowed anddebtis determinedwith} cost against the defendants^{ltis hereby orderedthat applicant bankis entitledto} recover from the defendants^{the total amountto the tune ot Rs' 72,02,394211'} (Rupees seventy two lakh two thousand three^{hundredninety four and paisetwentyone} only) with^pendentelite and^{future interest} @^{14.00ryoper annuminterest with srmple} on the amount due^{from the dateof filing of the OriginalApplication i'e' 2/O!/2O24I} full and final realization of the^{claim amount,}

t2) Amount, if any,^paid by the defendants^{in the loan accountsor amount, if any,} recovered by the Applicant^{Bank after filingof the O.A. the same be taken intoaccount} while arriving at the exact^{amount of dues/debt payableby the defendants'} Accordingly, pendentellte and future^{interest shallbe calculated on the reducedamount'}

(3) Defendants are debarred from disposing,^{alienatingor dealingwith any of the properties} belonging to them till the aforesaid^{decretal debt is recovered from the defendants'}

(4) Defendants are^given a time of thirty^{daysfrom the dateof the ludgement/FanalOrder} for repaying of the above mentioned dues,^{so intimated to them.In casethe defendants} fail to pay the dues within the above mentioned^{time, the applicant bank is entitled to} recover its dues by Sale of secured^{assets, if any. Applicant bankis also entitledto} proceed aqainst personal properties of the defendants^(Both movable and^immovable) and also Droceed against the defendants^{personallyto recover the dues in accordance} with law.

(s) Let the Certificate of^{Recovery be drawnup by Ld.Registrarforthwithin termsof} ludgement for issuance of^{the sameagainst defendantsin favourof the applicantbank} under Section 19⁽²²⁾ of^{the Recovery of Debtsand Bankruptcy Act,1993 and putup} the same for issuance of the^Certificate.

(6) Ld. Recovery Officer shall^{realizethe amount as perthe RecoveryCertificatefrom the} deFendants in accordance^{with law}

(7) Ld. Registrar of this Tribunal^{is directedto deliver recoverycertificatein term of the Frndl} order/judgement for^recovery of^{the sum againstthe defendantin favour of the} Applicant Bank under Section^{19 (22) of the Recoveryof Debts due to theBankand} Financial InstitLrtions Act. 1993^{now known as Recovery of Debts and Bankruptcy Act,} 1993.
