The Applicant Eank filed the^present O.A. being No. O.A.1174/2023^{on 20/0312023fot} recovery of a total sum of Rs. 24,52,85a.34/-^(Rupees twenty^{four lakh fifty two thousand} eight hundred fifty eight and^paisa thirty four only) from the Defendants towards^Cash credit together with interest, cost and other usual reliefs.

The Defendants are served with summons. The defendants did^not appear,^{as there was no} representation frorn the defendants, the case was fixed for ex-parte hearing^{on 211O2/2024,} and hedrd ex^parte accordrnglY.

The Applicant Bank examined 10 documents through^{RajatKumar Bala, Seniorlvanager} marked as Exhibit Annexure-A to Exhibit Annexure_A9.

As stated supra,^{the Defendant remained absent and did not turnup to controvert the} version of the^{O.A.of ApplicantBank The Ev'denceAffidavit coupled with the recitalsin the} documents viz.,^{Exhibits Annexure-Ato Exhibit Annexure-A9 marked on behalf of the} Applicant Bank,^{establishedthe claim of the ApplicantBankagainstthe Defendants and oA} schedule^{propertiesHence, I hold that the Defendantsare jointlyand severally liable to pay} to the Applicant^{Eank the claims madein the OA with futureinterest andcosts}

In the result, the^{present Original Applicationis allowed ex_parte with costs' as under:_}

(1) o.A. No. 174 of 2023^{filed by the ApplicantEank is allowed and debt is determinedwith cost} against the defendants,^{lt is hereby orderedthat applicant bank is entitledto recover from} the defendants^{the total amount to the tune of Rs24,52'85834l-(Rupeestwenty four lakh} fifty two thousand^{eighthundredfifty eightandpaisathirtyfour only)with pendenteliteand} future interest @^10.35olo Per^{annum interest withsimple on the amount due from the date} of filing of the Original^{Application i.e 20/0312023till full and final realization of theclaim} amount,

(2) Amount, if any,^paad by the^{defendants in the loanaccountsor amountr if any' recoveredby} the Applicant Bank^{after filingof the O.A the same be taken intoaccountwhile arrivinq at} theexactamountofdUes/debtpayablebythedefendants'Accordingly,pendenteliteand future interest shall be calculated^{on the reducedamount}

(3) Defendants are debarred from disposing,^{alienatingor dealingwith anyof thepropertles} belonging to them till the^{aforesaid decretal debt is recovered from the defendants}

(4) Defendants are given a time of thirty days^{from the date of the Judgement/Final Orderfor} repaying of the above^{mentioned dues, so lntimated to them ln casethe defendantsfail to} pay the dues within the above mentioned time,^{the applicant bank is entitledto recover its} dues by sale of secured^{assets,if any. Applicant bank is also entitled to proceed against} personal properties of the defendants^{(Bothmovableand immovable)and alsoproceed} against the defendants^{personallyto recover the dues in accordancewith law'}

(5) Let the Certificate of Recovery be^drawn up^{by Ld Registrar forthwith in termsof} JLrdgement for^{issuanceof thesame against defendantsin favour of theapplicantbank} under Section 19^{(22) of the Recoveryof Debtsand BankruptcyAct, 1993 and put up the} same for issuance of the Certificate

(6) Ld. Recovery Officer shall realize the^{amount as per the Recovery Certificatefromthe} defendantsⁱⁿ accordance with^law.
