Facility to the tune of Rs.10 lakhs from respondent bank on 13.01.2014. Despite repeated requests, as borrower did not come forward to repay the dues, respondent bank had classified the loan account as NPA on 29.06.2017 in accordance to RBI guidelines and issued Demand Notice dated 05.03.2021 under Section 13(2) of the Act claiming a sum of Rs.8,19,079.57p, which notice returned unserved with postal endorsement as ‘left’. Hence respondent bank had caused paper publication of demand notice in two leading newspapers and affixed the same in the secured asset as evidenced from typed set of documents filed along with counter. As neither borrower nor applicant came forward to repay the dues even after expiry of statutory period, respondent bank had issued the possession notice dated 01.02.2022, which was duly received by applicant on 03.02.2022, affixed on the secured asset and published in two newspapers viz., ‘Indian Express’ and ‘Dinamani’ on 04.02.2022 in compliance of all the requirements of SARFAESI Act and Rules made thereunder. As the default of the borrower continued, respondent bank proceeded further and issued sale notice dated 05.09.2022, which returned unserved to applicant, however the same was affixed on the secured asset on the same day and paper publication of sale notice was caused on 13.09.2022.
