It is alleged that a look at the notice issued U/s 13(2) of the SARFAESI Act would show that the bank has also ordered that it will enforce its security interest in respect of some of the properties which are agricultural in nature. As per Section 31 of the Securitization Act, the bank is not entitled to exercise the security interest in respect of the agricultural land. Further, in violation of the RBI Circular No.RBI/2020-21/61 DOR.No.BP.BC.26/21.04.048/2020-21 dated October 26, 2020 bank did not waive the interest charged during the Covid period. Applicant has alleged that he had challenged the notice dated 08.03.2022 issued U/s 13(2) of Securitization Act in the court of Sub-Judge Anantnag, Kashmir, which is pending. It is alleged that notice dated 08.03.2020 was withdrawn by the bank. Thereafter, the bank issued defective notice dated 11.05.2022 without complying Section 13(4) of the SARFAESI Act, 2002 and Rules thereunder. Further, on 07.06.2022, bank filed an application U/s 14 of the SARFAESI Act, before the District Magistrate, who ordered that the possession be delivered to the bank. The bank took the possession on 16.01.2023. Applicant, who is aged 60 years, was thrown out of his house with his family and children. Since then the applicant and his family are living in the open. Further, the bank has put up the property for auction against the provisions of law. On these facts applicant has filed the present SA for setting aside the notice under Section 13(2) dated 08.03.2022; possession notice dated 11.05.2022 and 16.01.2023; order of District Magistrate under Section 14 of the SARFAESI Act, 2002.
