Z, The brief facts of the case are that on the request of Defendant, the Appticant Bank sanctioned Kisan Credit Card (KCC) of Rs. 22.28 Lac on 27101117 and Term Loan of Rs. 24 Lac on 22102117. ln consideration of the sanction of said credit facitities, the Defendant in addition to execution of loan documents has a]so created charge under the provisions of M.P. Krishi Udhar Pravartan Tatha Prakriyan Upbandh (Bank) Adhiniyam 1972 over the immovable property, i.e., agriculture land bearing Survey No.-33/7,100, 101,102, 103, 105, 106, 107, 108, 109, 111 ,118, 119, 120, 125, 126, 132, 133 & 134 total area 7.489 hectares, situated at patwari Hatka No.-49, Vittage-Chandpura, Tehsil & District-Rajgarh. The Defendant avaited the credit facitities and executed tetter of acknowtedgement of debt/securities on 18102120 and 21112/19. The accounts became irregular and the Defendant faited to tiquidate the outstanding dues despite issuance of Legat Notice on 06103121 by the Appticant Bank. The Appticant-Bank has relied upon the documents at Ex. A-1 to A-21 which were proved by Shri Ravi Shankar Singh, Chief Manager.
