The defendantNo.'l had availed credit facility fromthe} applicant bank by^{opening and operating Cash Credit Loan Account No} 8085252306865^{with the applicant bank. The defendantNo 3 Sri Sajal Kanti Das} and Detendant^{No.4 Sri Nishi KantaDas stood guarantors to the loan availed by} the defendant No.'1.

Two Lacs Thirty-Seven^{Thousand Five Hundred) only. However, the applicant bank} has obtained latest^{Valuationreportof thepropertyfrom its empaneledValuerEr'} Subrata Dutta on^{O9-O l-2020 and as per this report the Schedule propeftyland-} locked and as such no^{valuation could be calculatedby the Valuer'}

The defendants had availed^{the credit facility fromthe applicantbank by} opening and operating^{Cash Credit Loan Account No. 8085252306865with the} applicant bank. At the^{initial stage,the defendantswere making regular repayment in} the loan account but^{subsequentlythey started committing default in making} repayment towards the^{loan. Due to occurrenceof the irregularitiesin repaying the} loan amount the Loan^{Account has been declared NPA (Non-Performing Assets)on} 31-03.2019. After the account^{became NPA the applicant bank issued notices for} repayment of the due amount,^{but the defendants failed to repay the loanamount or} renew the loan account.

The applicanl bank thus^{became constrained} to^{Iile the presentOriginal} Application for the recovery of Rs.^{20,03,708.15(Rupees Twenty Laca Three} Thousand seven Hundrcd Eight^{and Paise Fifteen)onlyas on 21j2.2021along} with interest and cost of the application.

After flling of the OA the Tribunal issued notice upon^the defendants^through registered^post and the applicant bank^{flledservice report} on^{18-05-2022,which} shows that service is completed upon the defendant^{No.3 and service} is^not completed upon the defendants No^1, 2 &^{4. Thereafier the Tribunal ordered paper} publication of notice upon the defendants No. 1, 2 & 4 and the applicant bank issued notice to the defendants No. 1, 2 & 4 on 28.05.2022 through Paper Publication in two newspapers namely "Tipura Times^" and 'Sandyan Patrika". Even after^proper service of notice upon defendant No. 3 and issuance of notice through^{paper publication} also lhere was no representation on behalf of the defendants No 4 either by the counsel or the person and hence the defendants No 3 & 4 were set ex-parte on 05.08.2022 and their right to file written statement cum evidence on affidavit^was closed.^The leamed counsel for defendants No.1 & 2 has appeared on 05.08.2022 and filed their written statement on the same day i.e. on 05.08.2022 to which leamed counsel for the

The learned counsel for^{the defendants No. 1 & 2has appearedand} contested the claim^{of the applicant bank by filing written statementcumevidence on} affidavit stating interalia that^{the original applicationis notmaintainable.Theoriginal} application is also^{baned by limitation.Theseansweringdefendantsdenied the} authenticity,^{genuineness and conectness of the documents liledalong with the} apptications. lt is denied^{that the answering defendant is liableto pay Rs. 20,03, 70815} as debt to the applica^{bankas on21112n021.lt is further statedthat the applicant Bank} is not entitled to^{get any relief/ lnterim relief as prayed for in the application'}

Heard the learned counsel^{for theapplicant bank whoprayed for issuance of} Recovery Certificate^{againstthe defendantsas per pleadingsmade in the Application,} supported by evidence^{on affidavit of their witnesswho affirmed on oath the execution} of the security and other^{documentsby the defendants and also execution of their own} documents relied upon,^{which have been markedexhibits'}

None has appeared for the^{defendantsNo. 1 & 2 to put forward their} arguments.

I have carefully^{perusedthe documentson record including original application'} evidence on afiidavit^{and exhibited documents as well as written statementtiled by the} defendants No.'l &^2.

It is obserued that the^{answering defendantsNo. 1 & 2 have made generaldenial} in their written statement.^{lt is well settled principleof law that the writtenstiatementmust} specifically deal^{with eachof the allegationof facl made in the plaint.The failureto make} specific denial amounts^{to an admission. tn the presentcase, the defendantshavemade} a general denial that^{amountsto admissionon thepartof the defendantsof the facls} pleaded in the original application by the^{applicant. It is evident from the^{statementof acrountfiled by theapplicantbank that the} defendantshavedefaultedinrepaymentoftheloan.lfthereisdefaultinrepaymentofthe loan the applicant^{bankhaseveryrightto proceed against the defendants for realization} of the outstanding^{dues. HenceI have no hesitationto hold thatthis original application is} maintainable.

The applicant bank^{has produced on recordthe copies of the statement of account} in respect of the defendant,^{dulycertified under BankeG' Books EvidenceAc{ The} applicant bank by the^{evidence-on-affidavit of Sri. Uttam Kumar Saha, Chief Managerof} the Applicant Bank^{had deposed the conectnessof the affidavit andcertifiedcopy of the} account.Beyondthatnothingmorehastobedeposedbyanoflicerofthebank.ltisthus obviousthatapartfromtheentriesoftheBooksofaccountthereareampleevidenc€on the record to conoborate^{the said entries.}

The documents^{executed by the principal borrowerand guarantorsfrom time to} time are duly^{proved by the applicant bank and the witness of the applicantltis also} found that the claim^{is within the periodof limitationThe applicanthas sufficient} cause of action^{for filing the instant applicationdue to disbursemenuavailment of loan} to/by the defendants^{and on default in repaymentof the loan by the defendants'} inspite of demands^{made, as per exhibited documentsfiled by the applicantbank'}

Considering the^{facts and circumstancesof the case' I am of the} consideredviewthatthedocumentsfiledbytheapplicantbankaresupportingthe claim of the applicant^{bank and establishingthe liabilityof the defendantslt is proved} that the defendants^{are jointly and severally liable to payto the applicant bank the} claim made in the^{Original Application.The loan was obtained and documentshave} been executed on^{29.05.2014,30.05 2014,25 05.2015'27 '05 2015 & 01 08 2017'} Moreover, after^{perusingthe documentson record and taking into considerationof the} factsandcircumstan@softhecase,lfindthatthemortgagehasbeencreatedby the defendant No.2^{where the limitation availableis for,l2yearsand as SUchtjakinginto}

account of the $eation of the mortgage^the application^{appearsto have been filed t/vell} within the^period of limitation. The account became NPA on 31^.03.2019 and the OA^has been ,lled on 31j22021. Hence, the OA is filed well within the^period of limitation and this Tribunal having a^jurisdiction to adjudicate the Original Application.

Considering the version of Sri. Uttam Kumar Saha, applicant's witness and all the documents marked as exhibits, including duly certified copy of the slatement of account along with interest calculation sheet maintained by the applicant Bank in it's regular cource of business, I hold that the applicant is entitled to get the Recovery Certificate as^prayed for.

ln the result, the present Original Application No. 03 of 2022 is allowed with cost as under :-

The defendants No. 1, 2, 3 & 4 are^jointly and severally liable to pay to ihe applicant bank a sum of Rs. 20,03,708.15 (Rupess Twenty Lacs Three Thousand Seven Hundred Eight and Paise Fifteen) only with pendentelite and future interest @14.50% p.a. with monthly rests from 22122021, till the date of full paymenurealization and also cost of the application.

ii) The charge of the certificated amount be kept alive on mortgaged property i.e. Land measurang 0.37 Acre within the Oistrict-North Tripura, TahsilKumarghat, Mouza- Pabiacherra, Khatian No. 771, Dag No. 5519/5885 & 5520/5886 under Kumarghat Revenue Circle together with the building standing thereon and is bounded by North: Kshitish Das; South: S. Paut; East: U. Das; West: Kshitish Das, as described in Schedule of the OA till the amount is realized in full.

iii) The applicant bank is entitled to proceed against the secured items towards recovery of the dues.

iv) The applicant bank is also entitled to proceed against the personal assets and properties of the defendanls towards recovery of the dues.
