defendants. Despite repeated requests, defendants did not make the repayment. Hence, this application. 3. On 31.03.2022, summons was sent to the defendants by registered post, which was duly served. However, defendants did not put in appearance. Vide order dated 28.10.2022, they were proceeded ex parte . 4. In order to prove its case, the Bank has placed on record the affidavit of Mr. Rajendra Prasad, Authorized Representative along with the loan and security documents and marked them as Exhibit A-1 to A- 11. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the credit facilities under CTG of Rs.20,39,831/- and also under CV-GECL of Rs.3,49,000/- and on 30.12.2021, a sum of Rs.21,45,517.48 was due. 6. Accordingly, the application of the bank for the recovery of Rs.21,45,517.48 (Rupees Twenty One Lacs Forty Five Thousand Five Hundred Seventeen And Paise Forty Eight Only) with interest @10.02% per annum with monthly rests from 11.01.2022, till the date of payment is hereby allowed with costs against defendants. The liability of all defendants would be joint and several. Bank can recover its dues by sale of the hypothecated vehicle bearing Model No. JCB 3DX, Engine No.H00219877 and Chassis No.HAR3DXSSC02809239 {fully detailed in para 5(3) of the OA}, as well as from the personal movable and immovable property(ies) of defendants. 7. Pending IAs, if any, stand disposed of. 8. Recovery Certificate be issued accordingly.
