| Advocate for the applicant present. None for the defendant. By way of the present appeal, the applicant is seeking restoration of the present OA lodging no. 153/2018. Ld. Counsel for the applicant submits that since the earlier Counsel did not took steps despite co-operation of the bank. Therefore, matter was dismissed however he submits now the applicant will pursue the OA regularly in case the opportunity may be allowed. Looking to the peculiar facts of the case the Chamber Appeal is hereby allowed with a warning to the applicant not to commit such type of delay in future and also cost of Rs. 5000/- which shall be paid with the Bar Association of Bombay, DRT, Mumbai. OA is hereby restored to original number and list before Ld. Registrar on 23/02/2023. |
