Counsel for the applicant submits that again SARFAESI Action has been initiated by respondent bank after disposal of earlier SA and respondent bank without following the provision of SARFAESI Act and Rules made thereof, issued sale notice and auction sale schedule to be held on today itself. Ld. Counsel for the respondent wants time to file counter affidavit. Ld. Counsel for the applicant submits that the auction sale which IS scheduled to be held on today may be stayed. Considering such circumstances of the case, the bank may continue for the auction sale which shall be subject to outcome of this SA. Ld. counsel for applicant submits that he has already moved before the bank for compromise which is still pending. The respondent bank may consider the offer made by the applicant as per bank policy.
