includes a Cash Credit facility with drawing power of Rs.1.25 crores and was regular in repayment thereby maintaining the limits. To secure the aforesaid facility, partners of the firm offered their immovable property as security and created equitable mortgage by executing a memorandum of deposit of title deeds of two properties in favour of respondent bank. Despite repeated requests made by applicant firm, respondent bank did not furnish sanction and MODT related documents. It is the further case of applicant that respondent bank did not provide renewal to the cash credit facility after sanction, despite applicant firm submitting necessary documents for the same. On account of Pandemic Covid-19 and lockdown imposed, applicant‟s business was very badly affected. Despite hard times, applicant was prompt in making repayments into the loan account. However, to the shock and surprise of applicant, respondent bank had issued Demand Notice under Section 13(2) of the Act on 12.05.2021 declaring the account as NPA on 30.04.2021, followed by the Possession Notice dated 13.09.2021. After receipt of possession notice, applicant approached respondent bank requesting for loan documents and in that context issued a notice dated 16.02.2022, which was replied by respondent bank through their counsel on 23.02.2022 giving evasive reply.
