Heard learned counsel for the parties.

It appears that a compromise settlement was arrived at between the parties in the Lok Adalat held on 14.02.2026 at Darjeeling wherein a joint compromise petition was filed. Lok Adalat in condition no.2(b) of the order dated 14.02.2026 stated that “Balance amount payable from the date of filing of the joint compromise petition as per the following terms without interest. Balance amount of Rs.16.00 lakh has to be deposited directly to the bank within seven days after receipt of the amount from DRAT, Kolkata.

An amount of Rs.21.70 lakhs is deposited by the appellant as pre-deposit in appeal. A joint compromise petition is filed

regarding settlement between the parties, which is in terms of the settlement arrived at before the Lok Adalat held at Darjeeling. Learned counsel for appellant would submit that an amount of Rs.16.00 lakh as settled between the parties may be transferred to the respondent bank by the Registrar, DRAT, Kolkata directly and remaining amount of pre-deposit may be refunded to the appellant.

It is submitted that authorized officer of the bank is present in court. His presence is dispensed with.

Accordingly, appeal is disposed of with the direction to the Registrar, DRAT, Kolkata to remit an amount of Rs.16.00 lakh to the respondent bank. Appellant is entitled to receive rest amount of pre-deposit including accrued interest. Needless to observe that on receipt of the amount, respondent bank shall issue NOC as well as return the security documents to the appellant within a period of three days from the date of receipt.
