The matter is taken up for hearing by way of a praecipe filed by the applicant for seeking urgent relief.
The applicant is the auction purchaser who has paid the entire sale consideration liable to be deposited within the stipulated time. However, Appeal No. 16/2022 is still pending before the Debt Recovery Tribunal-II, Mumbai (D.R.T.) and this application is filed for directions to the D.R.T. to dispose of the aforesaid appeal expeditiously because the applicant has paid the entire sale consideration.
The respondent bank has no objection to the proposal and hence, the application is allowed and the D.R.T.-II, Mumbai is directed to dispose of Appeal No. 16/2022 as expeditiously as possible at any rate within two months from the date of the receipt of this order.
