THE APPELLATE TRIBUNAL :

Heard the Learned Counsel for the parties and perused the record.

2. Instant Appeal has been preferred against an order passed by the Learned DRT-1 Kolkata directing the Bank not to create any third party interest until the I.A. No. 1065 of 2024 is disposed of by the Learned DRT. It so appears that pending S.A., I.A. was filed wherein challenge to the action taken by the Bank were made. Learned DRT passed an order that possession of secured assets have been taken by the Bank. Same shall be subject to the final order of the I.A. However, a restraint order has been passed not to create any third party interest by the Bank pending I.A. No reasons have been assigned for passing this restraint order. 3. Without entering into the merits of the matter, Appeal is disposed of with a direction to the Learned DRT to take up the matter on 6^th January, 2026 for deciding the I.A. No. 1065 of 2024. It is made clear that the matter should not be adjourned. If any adjournment is sought by the S.A. Applicant, Learned DRT would be at liberty to vacate the interim order passed by him on 13.05.2024. Parties are directed to appear before the Learned DRT on 6^th January, 2026 for further hearing.
