The respondent bank has filed this application for condonation of delay for 2167 days to set aside the ex-parte order passed in this appeal filed by the appellant. The bank has serious contentions to be raised in this appeal. The Ld. Counsel appearing for the appellant has objections in entertaining this application.
The reasons stated in the application for condonation of delay may not be prima facie acceptable. However, it is in the interest of justice that an opportunity is to be given to the bank to contest this appeal on merits as it is pointed out that there are no merits in this appeal. Hence, the application for condonation of delay is allowed subject to payment of ₹25,000/- to DRT Bar Association within two weeks for the purchase of books and periodicals.
