THE APPELLATE TRIBUNAL :
Heard learned counsel for the appellant. Respondents are served, but no represented.
Learned counsel for the appellant submits that the matter is pending before the Recovery Officer, DRT-3, Kolkata wherein property was sold, auction purchaser deposited the bid amount. Only sale to be confirmed.
Having considered the submission made on behalf of the appellant bank I find the ground is sufficient and confirmation of sale is to be made. I also find that there is no Recovery Officer in DRT-3 Kolkata. Accordingly, Transfer Petition is allowed and R.C. No. 450 of 2019 is transferred from file of Recovery Officer, DRT3 Kolkata to Recovery Officer, DRT-2 Kolkata for disposal in accordance with law.
Transfer Petition No. 29 of 2023 is disposed of.
